To understand how divorce works in New York, it’s crucial to understand the critical matters that need to be resolved before a divorce can be finalized:

  • Division of marital property and debt: New York is an equitable distribution state, meaning that marital property is divided fairly, though not necessarily equal. The court considers many factors, such as the length of the marriage, each spouse’s earning ability, income, and property when they married, a parent’s need to remain in the family home to raise children, each spouse’s age and health, and other issues.
  • Child custody and visitation: If the couple has children, the court will determine both physical and legal custody arrangements, with the child’s best interest as the guiding principle. Visitation rights for the noncustodial parent are also determined.
  • Child support: Child support is calculated based on each parent’s income and the number of children needing support. The purpose is to ensure that the child’s financial needs are met and that the child receives the benefits of both parental incomes.
  • Spousal support (alimony or maintenance): Spousal support is awarded case-by-case. Factors considered include the duration of the marriage, the age and health of both parties and each spouse’s income and property.

Grounds for Divorce

New York State recognizes both no-fault and fault-based grounds for divorce. The most common and least confrontational is the no-fault divorce, where one party asserts that the relationship has been irretrievably broken for at least six months. A no-fault divorce avoids the litigation involved in proving marital misconduct on the part of a spouse. Thus, your divorce can proceed faster as long as you and your spouse agree on the child-related, property, or financial matters of your case. 

In contrast, fault-based divorces can involve accusations such as adultery, cruel and inhuman treatment, abandonment, or the imprisonment of a spouse for at least three years. Fault-based grounds must be proven in court. 

You must also meet residency requirements to file for divorce. You or your spouse must have lived in New York continuously for two years or one year if you were married in New York or lived there as a married couple.
